Terms of Service

These Terms of Service (“Terms”) govern your access to and use of StoryStork (“we”, “us”, or “our”), operated by Simulatecx Inc. By creating an account or using StoryStork, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. StoryStork accounts are for adults; content may be generated for children but must be managed by a parent or guardian.

2. Description of Service

StoryStork is an AI-powered creative platform for generating personalised children's stories and grown-up fiction. The service includes:

• AI story and poem generation (powered by Google Gemini)
• AI cover art and character portrait generation (powered by fal.ai)
• Text-to-speech narration and voice cloning (powered by Mistral Voxtral)
• A community story library with browsing, upvoting, and story variations
• Persona management, anthologies, and story collections

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not share accounts. Notify us immediately at info@storystork.ai if you suspect unauthorised access.

4. Tokens, Subscriptions & Billing

4.1 Token System

StoryStork uses a token credit system. Each plan receives a monthly token allotment that refreshes at the start of each billing cycle. Unused tokens do not roll over. Token costs vary by action (story generation, narration, cover art, portraits) and by length — see the pricing page for current rates.

4.2 Subscriptions

Paid plans (Storyteller, Dreamweaver) are billed monthly in advance. Cancellations take effect at the end of the current billing period; you retain access and tokens until then. We do not offer refunds for partial billing periods or unused tokens.

4.3 Token Top-Ups

One-time token packs may be purchased at any time. These tokens are non-refundable, never expire, and stack on top of your monthly allotment.

4.4 Price Changes

We may change plan prices or token costs with 30 days' notice via email or in-app notification. Continued use after the effective date constitutes acceptance.

5. User Content

5.1 Ownership

You retain ownership of content you generate using StoryStork, including stories, titles, and personas you create or name. You are responsible for all inputs you provide.

5.2 Public Content License

When you make a story public, you grant StoryStork and other users a non-exclusive, royalty-free, worldwide license to display, read, and fork that story as part of the platform's community features. This license ends when you remove the story from public view.

5.3 Story Variations & Attribution

Any user may fork a public story to create a variation. Variations automatically carry attribution to the original author and maintain a lineage back to the root story. By making a story public, you consent to it being forked and built upon by the community under these attribution terms. You cannot revoke attribution from variations already created.

6. Acceptable Use

You agree not to use StoryStork to:

• Generate, store, or distribute content that is illegal, harmful, or sexually explicit
• Generate content that targets, exploits, or endangers minors
• Attempt to bypass, jailbreak, or circumvent content safety filters
• Scrape, crawl, or extract data from the service at scale without written consent
• Reverse-engineer, decompile, or reproduce any part of the service
• Impersonate other individuals or misrepresent your affiliation
• Abuse generation systems, spam creation, or exploit token systems

7. Voice Cloning

Voice cloning is available on Storyteller and Dreamweaver plans. By submitting a voice recording, you confirm that:

• You are the person speaking, or you have explicit consent from the person whose voice you are cloning.
• You will not use a cloned voice to impersonate anyone without their consent, or for any deceptive purpose.
• Voice samples are processed by Mistral and stored securely. We do not use your voice data to train AI models without your explicit written consent.
• Creator voices you choose to list on the marketplace will be publicly usable for story narration by other StoryStork users, subject to the royalty terms stated at time of submission.

8. AI-Generated Content

AI-generated stories, images, and narrations may occasionally be inaccurate, incomplete, or inconsistent. We apply content filters at generation time but cannot guarantee all output is appropriate for all audiences. You are responsible for reviewing generated content before sharing it with others, particularly children.

Stories made public on the platform are subject to automated content moderation (NSFW detection). We reserve the right to remove or unpublish content that violates these Terms at any time without notice.

9. Image Uploads & Portraits

StoryStork allows image uploads for persona portraits and character customisation. You agree that:

• You will not upload identifiable photographs of real children or minors. AI systems may process uploaded images with third-party providers.
• You have the right to use and share any image you upload.
• We recommend cartoon or illustrated reference images rather than real photographs.
• StoryStork bears no liability for images you choose to upload.

10. Intellectual Property

The StoryStork platform, brand, design, software, and underlying technology are owned by Simulatecx Inc. and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of the platform to you.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your token balance is forfeited. Public content you have published may remain visible subject to existing forks and community lineage.

12. Disclaimers & Limitation of Liability

StoryStork is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

14. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email or via an in-app notice. Continued use after the effective date constitutes acceptance of the updated Terms.
